I-485 pending: Should I apply for H-1B? 1 Year, 9 Months ago
I am 485 pending with priority date 2007/02. I submitted 485 with my husband who is the primary applicant. I started working on my EAD later. Our concern is that my husband has changed his job since 485 submission and is now also working on his EAD, so their might be the chance that our 485 got rejected. Should/can I/we apply for H-1B? (If we do not apply for H-1B then if our 485 got rejected, we both can no longer work.) If we can apply for H-1B, will it help? For example, what will happen if our 485 are rejected? can we still work on our H-1B?

I am considering apply for EB1B, but not sure whether I qualify or how much support I need from my employer.

Thank you very much.

You should not go back to H-1B once you have used your EAD. You should ask your lawyer about it.
