EB-5 Immigrant Investor Program Case Example: What Form I-526E Receipt Notice Looks Like and Its Processing Timeline

After the U.S. Congress enacted the new EB-5 immigrant investor program rules in 2022, EB-5 immigration applications for investments in rural projects or high-unemployment area projects have picked up steam again.
Some readers say they have never seen a receipt notice for an EB-5 application filed under the new policy and are eager to find out what it looks like and approximately how long it takes to receive the notice.
We received a letter from U.S. Citizenship and Immigration Services (USCIS) about one week after we submitted the EB-5 immigrant investor application.






Since there is no official receipt number printed on this letter, we refer to it as a Receipt Letter.
This Receipt Letter, however, is of great importance, as it specifies the type of investment project the applicant has invested in. The project type determines the investor’s eligibility for a green card as well as the potential waiting time required.
Approximately one month later, our law firm received the following notice issued by U.S. Citizenship and Immigration Services (USCIS):




This is the official receipt notice issued by U.S. Citizenship and Immigration Services (USCIS).
It shows several pieces of extremely important information, including the applicant’s receipt number, priority date, Alien Registration Number (A-Number), etc.
For all applicants who have invested in the first three project types specified in the aforementioned Receipt Letter—Rural Projects, High-Unemployment Area Projects, or Infrastructure Projects—we have filed concurrent applications on their behalf, covering the immigration petition, adjustment of status application, employment authorization application, and advance parole application.
Within one to two weeks after submitting the concurrent applications, we will also receive the receipt notices for all these applications. Approximately four months later, we will obtain the approval notices for the EB-5 clients’ employment authorization and advance parole.
Subsequently, we will receive the following Combo Card that combines both employment authorization and advance parole functions!



This Combo Card is equivalent to obtaining a "conditional green card lite".
With this Combo Card, our EB-5 clients may freely enter and exit U.S. ports of entry.
With this Combo Card, our EB-5 clients may apply for any job they wish (excluding federal government positions).
With this Combo Card, our EB-5 clients who are currently studying in the U.S. no longer need to maintain their student status.
With this Combo Card, our EB-5 clients who are currently working in the U.S. may switch employers or start their own businesses.
Of course, it is highly advisable to contact or consult your case-handling attorney before taking any of the above actions to ensure everything goes smoothly without a hitch.
