U.S. Citizenship and Immigration Services (USCIS) will launch a revamped online registration and filing system for H-1B applications within this month. However, the exact official launch date remains unknown.
All U.S. employers filing H-1B applications on behalf of foreign national employees must register for a corporate online account.
All H-1B application forms may be submitted electronically via the online system.
Requests for premium processing of H-1B applications can also be filed online.
Representative attorneys are authorized to submit H-1B-related forms and documents on behalf of companies through the online platform.
USCIS is currently conducting usability testing on this revamped H-1B online filing system, including testing the different roles and permission scopes assigned to various login accounts under a single corporate profile.
Once the revamped H-1B electronic filing system is implemented, company owners, HR managers, representative attorneys, and paralegals will each be assigned distinct login permissions and defined scopes of work.
Although the revamped system has not yet been officially released to the public, it can be inferred that its full operation will help the U.S. government strengthen oversight of H-1B applications and improve processing efficiency.
A fully electronic H-1B filing process will eliminate the need for USCIS to re-enter data manually, which will effectively shorten the H-1B application review timeline.
The fully electronic system will also enable USCIS to promptly access both macro-level data on H-1B lottery selections and applications, and case-specific details pertaining to individual employers’ H-1B filings.
Even after H-1B applications become fully processable online, paper-based filings will still be permitted. That said, it is anticipated that the traditional practice of submitting paper applications and supporting documents will gradually decline over time.
At this time, the official release and enforcement date of the revamped H-1B electronic filing system has not been clarified. Please follow this column for the latest, first-hand professional updates on U.S. immigration policies.
