EB-5 Investment Immigration: How Long Will the Concurrent Filing Window Remain Open? (Part 3)

On November 14, 2023, we published the article titled “EB-5 Investment Immigration: How Long Will the Concurrent Filing Window Remain Open?”, in which we discussed when the concurrent filing window might close and ventured to predict that it was highly likely to stay open throughout the first half of 2024. Now it seems our speculation back then was correct!
The Visa Bulletin for June 2024, just released by the U.S. Department of State, indicates that applicants eligible to file for EB-5 investment immigration status within the United States can still submit Form I-526E and Form I-485 (Adjustment of Status) concurrently in June 2024. This allows them to obtain an Employment Authorization Document (EAD) and Advance Parole in one step, followed by a green card later on.


How to read the two tables above? It’s quite simple: refer to Table A to find out how much longer you will wait to obtain a green card or immigrant visa; refer to Table B to check your eligibility to file an adjustment of status application in the United States.
Given that the concurrent filing window will remain open next month, we recommend that eligible EB-5 readers prepare their application documents as soon as possible and strive to submit their immigrant visa applications via concurrent filing in June 2024. Whether concurrent filing—submitting both the immigrant visa application and adjustment of status application to USCIS—will still be available in July 2024 will not be known until early June 2024.
